Terms and Conditions for The Botanist survey, distributed 11th September 2018

  1. This competition is open to UK residents aged 18 and over and who provide their name, email address and telephone number after completing The Botanist online research survey, distributed on 11th September 2018.
  2. Entry to the competition is free.
  3. One entry is allowed per person.
  4. Entrants to the competition shall be deemed to have accepted these Terms and Conditions.
  5. The competition will run from 10:00 (GMT) on 11/09/2018 until 17:00 (GMT) on 25/09/2018.
  6. Employees of The Botanist, their associated, affiliated or subsidiary companies and their families, agents or anyone connected with the competition may not enter the competition.
  7. The competition winner will be drawn at random on 28/09/2018 from all eligible entries received prior to the close of the competition. The winner will be notified by email within 28 working days from the draw date.
  8. The competition prize is a £100 voucher for The Botanist, sent to the winner via email.
  9. Prizes are not refundable, exchangeable, replaceable or transferable for cash under any circumstances.
  10. The winner(s) agree(s) to the use of their name and image in any publicity material relating to the competition. Any personal data that is collected as part of the competition will be retained by Elliotts Agency Ltd only, for a period of 28 days maximum.
  11. The Botanist accepts no responsibility for any costs associated with the prize and not specifically included within the prize (including, without limitation, travel to and from the restaurant).
  12. The Botanist accepts no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason.
  13. The Botanist retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available.
  14. The Botanist accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the competition or accepting the prize. The Botanist further disclaims liability for any injury or damage to your or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the competition. Nothing in these Terms and Conditions shall exclude the liability of The Botanist for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
  15. The Botanist reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this competition with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of The Botanist in all matters under its control is final and binding and no correspondence will be entered into.
  16. The Botanist shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
  17. The competition will be governed by English law and entrants to the competition submit to the exclusive jurisdiction of the English courts.
